Often we can avoid labor certification
and lengthy
quota delays by
using priority immigration categories for outstanding
workers who will have a significant positive impact on American
society.
EB-1 immigration categories include:
1) Managers and executives who transfer
from the employer's offices outside of the U.S.
2) People with "extraordinary
ability" in the arts or sciences (scientists, performers,
musicians, actors, artists, and chefs who are among the
small percentage of people who have risen to the very top of
their profession).
3) Outstanding professors and
researchers, including researchers with private companies.
Green card applicants who do not qualify
for EB-1 classification may also avoid labor certification
with a National Interest Waiver ("NIW") if they can
demonstrate that their work is in the "national interest."
